			<content:encoded><![CDATA[<p>Businesses and individuals who operate commercial motor vehicles in Ontario must have a valid Commercial Vehicle Operator Registration (CVOR) certificate. The Ministry of Transportation is the government agency responsible for the CVOR program in Ontario. There is a CVOR Carrier rating system in place and CVOR Points are assigned upon conviction for most Highway Traffic Act offences. If a carrier gets too many points the MTO may order some or all of the fleet vehicles out of service. The MTO may also inspect the documentation held by carriers for their fleet of vehicles and drivers. There are many requirements under the Highway Traffic Act and failing to meet the requirements can cause a carrier to be assigned a low CVOR rating.</p>

<p>An OPP officer with the Napanee highway traffic unit pulled a motorist over Friday for a validation tag infraction. What caught the attention of the officer was the licence plate being clean, except for a piece of dirt covering the val tag. </p>
<p>The driver said there was no documentation for the plate or vehicle and said: &#8220;I am on my way to start serving my intermittent sentence for driving suspended. I was going to ride my bike, but it was raining and I don&#8217;t have a home phone to call a taxi.&#8221; </p>
<p>An unnamed female driver, 36, of Entreprise, faces a slew of charges, including driving while suspended. She was before a justice of the peace May 8 and, once released, she began serving her previous sentence for driving suspended</p>

			<content:encoded><![CDATA[<p>Summer is practically here and the drivers are out driving more and taking advantage of the good weather.  Drivers may not be aware of the implications of stunt driving laws in Ontario while they are driving this summer.  Decisions made by Welland and Belleville courts have made the Provinces stunt driving laws unconstitutional due to two Ontario stunt drivers’ cases that were ruled unconstitutional.  Since this decision the Court of Appeal for Ontario has overruled the law being unconstitutional to being constitutional.  There is now a retrial ordered and the appellate court upheld the Province’s law of speeding 50km/h and over or stunt driving.  The due diligence defence is used now because of this decision, which helps certain drivers in certain circumstances to have a defence.</p>
<p>Stunt driving is driving a motor vehicle 50 km/h or more over the speed limit and also includes a driving a motor vehicle on a highway in a race or contest, while performing a stunt or on a bet or wager.  Stunt drivers that exceed 50km/h or more are faced with a large fine or imprisonment or both.  The drivers who go 50 km/h or more are faced with a large fine and the suspension of their driver’s licence.  No drivers want their licence taken away or pay large fines or even spend time in prison during their summer vacation.  So let D.C. <p>As of May 2008, the Ontario Provincial Police (O.P.P.) is now using a Cessna aircraft to observe drivers from a birds-eye view. The last time the O.P.P. used planes, on a regular basis to patrol Ontario highways, was from the mid-sixties to the early eighties when the program ended. From that point on, only leased aircraft were used during long-weekend blitzes.</p>
<p>Being able to observe potentially hundreds of cars at one time, allows the officers on the highways to intercept dangerous drivers that otherwise might not be caught by traditional squad cars. The major highways have now been painted with markings that allow officers to use various techniques to determine if a driver is operating his or her vehicle in an illegal manner. These lines painted on the highway every 500 meters, allow the officers in the plane to measure the time that elapses while a vehicle is moving from one line to the next. Based on the measurements, a speed can be determined, and information about the vehicle is then relayed to ground units, who then pull the vehicle over and issue an offence notice.</p>
<p>Enforcement is not limited to speeders either. The O.P.P. has also been catching drivers who have been racing, stunt driving, driving carelessly, changing lanes unsafely, and more. It can be difficult to argue certain defenses when an aircraft is used during the traffic stop. An officer in a helicopter or plane is in a position to observe the vehicle from the time of the offence until the traffic stop, without losing sight of the vehicle, which in some previous cases has proven as a very effective defence.</p>
<p>Now more than ever, it is important for a driver who is charged with an offence to speak to a licenced professional. A licenced Paralegal who practices in the Provincial Offences Act court on a regular basis will be able to advise a person as to what their options are. A driver should be able to have a free initial consultation with a paralegal, so it is important to have all the details of the offence and documents handy when you call. Be sure to ask questions if you don’t understand what the paralegal is saying, or if one of the documents you received from the police is not clear to you. <p>O.P.P. Seat Belt Blitz is On Now in Ontario</p>
<p>A seatbelt blitz has started Wednesday April 14, 2010 through April 25, 2010 by Ontario Provincial Police across Ontario to crack down on deaths and injuries due to not using seatbelts.  This campaign will also focus on child restraint laws.  Child safety is a high priority, as many drivers do not install their child seat properly or use it incorrectly. There are clinics that illustrate how to properly install these seats which improves the safety of your child.  The legislation also bans two or more people using the same seatbelt at the same time.</p>
<p>Every person riding in a motor vehicle must wear a seat belt or use a child safety seat. A Driver facing a seat belt violation can be confronted with a fine between $60 and $500 and two demerit points (plus a victim surcharge). Demerit points remain on a driving record for two years from the date of the offence. The driver of the vehicle must make sure the passengers under 16 years of age use a seat belt or an appropriate car seat properly.  Passengers that appear to be at least 16 years old may be requested by police to provide their name address and birth date.  If these passengers are not wearing a seatbelt properly they may face a fine.</p>
<p>Everyone must wear a seatbelt whenever moving in a vehicle, including a taxi. The taxi driver has the responsibility to make certain that the seat belt is available and in good working order. The taxi drivers are also responsible for ensuring that passengers under the age of 16 are wearing seat belts. An exemption to the law for the taxi driver is that they are not required to provide a child car seat. The passenger in the taxi may provide their own child or booster seat. Other exemptions to this seatbelt law are:</p>
<ul>
<li>Police officers</li>
<li>Employees or Agents of the Canada Post Corporation</li>
<li>Fire Fighters</li>
<li>People with certain medical problems</li>
<li>Ambulance Attendants</li>
<li>Drivers while driving in reverse</li>
</ul>
<p>Using a seat belt is the best way to decrease the chance of harm or death in a motor vehicle accident. For every one percent increase in seat belt use five lives are saved.   That is why this blitz is very important, for our safety and to help us remember how important wearing your seatbelt really is.  So if you or someone you know is charged with a seat belt infraction in the next two weeks or anytime D.C. Paralegal Services" width="150" height="150" /></a>Commercial Drivers have more to worry about than the average driver. There are many rules and regulations that professional drivers must follow when driving in Canada, U.S.A., and Mexico. Although there are variations from country to country and state/province to state/province, the basics are the same across the board.</p>
<p>Commercial Drivers must complete a log book in most cases and in every case, the driver must inspect their vehicle and any trailers before, during and after any trips. There are restrictions in each jusidiction regarding the size and weight of the load being hauled. It is the Drivers responsibility to ensure that all rules and regulations are being followed or both the Driver and Vehicle Owner may face charges.</p>
<p>Commercial Vehicles are subject to inspections at designated weigh stations and at road-side inspections. The driver must be able to produce a completed log book and all vehicle documentation and must also assist with the inspection of the vehicle, if requested to do so.</p>
<p>Commercial Vehicle Operator Registration holders must ensure the vehicles they have on the road meet all Ministry of Transportation standards. If the vehicles fail an inspection or if the Driver is charged while driving a commercial vehicle, the Operator/Owner will accumulate CVOR Points. If a company accumulates too many CVOR Points the company will face consequences such as vehicles being ordered off the road for a set period of time. If the company&#8217;s rating is bad enough, the Ministry of Transportation may revoke the privilege of the Company being able to operate Commercial vehicles on the road. This can cost a company thousands of dollars in lost revenue and lost business.</p>
