Do you need our help? Here’s how we get started:

1. First we ask the client many questions to be sure we have a complete understanding of their version of what happened. We sometimes have to ask our clients difficult questions, but as long as the answers are honest, it allows us to properly prepare a defence to the charge(s).

 

2. The second step is for us to examine the Offence Notice and/or Summons looking to find any fatal errors that could lead to the charge(s) being dismissed.

 

3. Next we file the Offence Notice at the Provincial Offences Court and request a Court Date.

 

4. We then request the Disclosure for your case. The Disclosure will include copies of the evidence the Prosecutor plans to use in your case. In the Disclosure Package you may find, a copy of the Driving Record, Police Officer(s) Notes, Witness Statements, Pictures, Diagrams, and more. We know what is required to be in the Disclosure Package and if something is missing, we ask for it.

 

5. We then review the Disclosure Package very carefully, looking for any missing information and/or incorrect information.

 

6. We then carefully craft a defence for the case that will lead to the best outcome for the client based on our years of experience in the Provincial Offence Courts.

 

7. We then discuss the case with the Prosecutor and explain the Defence to him or her. If a strong defence is properly presented and supported, the Prosecutor may withdraw the Charge(s). If not, in most cases we are able to get the charge reduced to a charge that carries fewer or zero Demerit Points.

 

8. If the Prosecutor is not willing to withdraw the charge or negotiate to a lesser charge, we normally would have a Trial and challenge the Officer’s and Witnesses Evidence and in many cases we would call witnesses to give Evidence in our clients Defence.
